What does “acting on both sides” actually mean?

When you buy or sell a home, you need a conveyancer to handle the legal work. The buyers need one, and the sellers need one. In a typical transaction, these are two entirely separate firms, with no connection to each other.

“Acting on both sides” means that one firm handles both the buyer’s legal work and the seller’s legal work simultaneously. The same company, but not the same property lawyers.

It’s more common than many people realise, and it’s perfectly legal, providing that the correct safeguards are in place.

Why is there a concern about “acting on both sides”?

The hesitation around a firm acting for both sides is understandable, and it comes from a legitimate principle, a conveyancer has a duty to act in their client’s best interests. If the same conveyancer has visibility of both the buyer’s file and seller’s file, there is a genuine risk of bias, or at the very least a perception of it.

This is why many firms can’t or don’t offer acting on both sides at all, and why that caution is widely passed on to consumers as general advice.

There is one more thing worth knowing. We will only ever act on both sides when every party has given their express consent. Before anything begins, we make sure everyone is fully informed and comfortable with the arrangement. If either party would prefer us to act for one side only, that is absolutely fine, we will simply do that instead.
